Date: 2009/12/12

Information Covered

This Privacy Policy covers Personally Identifiable Information ("PII") collected on and after the date associated with this Privacy Policy. PII is collected on websites where this policy is posted, as well as their associated web services, such as a game matching service used in a game downloaded from this website. The covered websites and associated web services as of the date of this Privacy Policy are as follows:

hazardoussoftware.com
achrongame.com

This policy does not apply to any information collected by Hazardous Software INC. ("Hazardous Software") through any other means. This Privacy Policy is subject to all applicable laws.

Types of PII Collected

PII is collected for users who visit our websites and use our products. We may use PII to identify and contact you.

We do not knowingly collect PII from persons aged 13 or younger.

We do not require PII to access our site. However, we do require disclosure of some PII in order to purchase our products or access some features on our site.

We use PII for the following purposes:

(i) Creation and registration of accounts with our website
(ii) Purchase and download of products and content
(iii) Participation in forums and content sharing
(iv) Game matching
(v) Dissemination of news related to Hazardous Software and its products
(vi) Surveys and questionnaires
(vii) Provision of technical support
(viii) Improvement of our products

The PII collected typically consists of a subset of the following information:

(i) Name
(ii) E-mail address
(iii) Telephone number
(iv) Instant messenger screen names (e.g., AIM, Gtalk, MSN)
(v) Address (in particular, country and postal code)

Additionally, we may collect other types of information other than PII, such as date of birth, hobbies, interests, game statistics, IP address, operating system, computer hardware used, and your usage of websites and web services owned or run by Hazardous Software. We collect this information about our users and customers for the purpose of improving our products and web offerings. We may combine this information with PII.

Our websites do use "cookies." Cookies are a standard technology in web browsers. Our website sends information to your computer to remember your login credentials and settings to improve your browsing experience. Cookies may be disabled in nearly all browsers, though the process is slightly different for each browser. See your browser's help function for further information. We may combine data from cookies with PII.

Personally Identifiable Information Usage

We do not disclose your PII to third parties, partners, or any other affiliates without your consent, but your PII may be accessible to our contractors (such as website hosting providers) that are bound by confidentiality obligations and required to use your PII only for provision of services to you or to us. We may, however, share aggregations of such data with third parties or the public, with all PII removed. We may also share "anonymized" data, where the data is preserved, but all PII is scrambled such that it cannot be reconstructed and the data cannot be traced back to its owner.

We may use your PII for administrative uses, such as corresponding with you about your account, website features, or technical support.

If Hazardous Software ever sells or transfers part of its business to another entity in a way that would include transfer or sharing of PII, Hazardous Software will include provisions in the sales contract such that all PII transferred or shared will be treated under this Privacy Policy. This Privacy Policy will remain intact for your PII even if Hazardous Software is acquired by another entity or is forced to sell data in bankruptcy proceedings.

Disclosures Required by Law and to Protect Safety and Security

We will disclose PII if we believe in good faith that the disclosure is (i) required by law, such as complying with a court order or subpoena, or (ii) will help enforce our Terms of Service or improve safety or security of property that belongs to you, Hazardous Software, or a third party.

Your Choices

You have direct control over the PII disclosed to us. If you ever decide to remove your PII from our database, you may do so from within your account, but removing certain information may limit your ability to utilize some of Hazardous Software's products, including products you may have purchased. You should know that removal of your information from your account will not necessarily remove your information from backup or archived information databases, and Hazardous Software will not be restricted from using any such archived information in anonymized or statistical data used by us internally or distributed to others provided that individual PII cannot be reconstructed from such data.

Hazardous Software will not knowingly enroll you in any e-mail or other distribution list without your request, initiation, or approval.

For any requests or questions regarding our Privacy Policy, please send an e-mail to us at privacy@hazardoussoftware.com

.

Security of Personally Identifiable Information

Your security and privacy are important to us, and we have safeguards in place designed to keep PII private. We use industry standard security technology on our databases, applications, and websites, and access to PII is limited to only those Hazardous Software employees and contractors that need access to PII for legitimate business reasons. Please remember that, despite our efforts, no security system is perfectly safe and secure.

Changes to Privacy Policy

We may amend this Privacy Policy at any time. However, if we make any material changes with how we handle or use PII, we will notify you via e-mail 30 days prior to when the amended Privacy Policy would take effect. You are responsible for keeping PII, such as e-mail address up to date. Our sending of the e-mail to the most recent e-mail address you have provided us will constitute an effective notice of a change to our Privacy Policy.
